Welcome to LevelLife. These Terms & Conditions ("Terms") govern your use of the LevelLife application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old or the minimum age required in your jurisdiction to use the Service. If you are under the age of majority, you represent that you have obtained parental or guardian consent.

2. Accounts

When you create an account, you must provide accurate information and keep it updated. You are responsible for safeguarding your account credentials and for all activities under your account.

3. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, without limitation: attempting to access non-public areas, interfering with the Service, reverse engineering, uploading malicious code, or using the Service to violate any law or third-party rights.

4. Subscriptions, Billing, Taxes, and Refunds

Subscriptions are billed in advance on a recurring basis until cancelled. Purchases and subscriptions made via the Apple App Store or Google Play are processed by those stores, and their terms (including renewals, cancellations, refunds, and taxes) apply. We do not collect or store your payment card details. Fees are exclusive of taxes unless the app store includes tax in the displayed price; you are responsible for all applicable taxes as determined by the store. We may change pricing with at least 30 days’ notice effective on the next renewal, subject to the store’s processes. If a renewal charge fails, the store may suspend access until payment is received.

5. Content and Feedback

You retain ownership of content you submit to the Service. By submitting content or feedback, you grant LevelLife a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely to operate and improve the Service.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect and use your information.

7. Third-Party Services

The Service may integrate with third-party platforms (e.g., app stores, analytics). Your use of those services is subject to their terms and privacy policies.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. LevelLife does not guarantee that the Service will be uninterrupted, secure, or error-free, or that results will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, LevelLife and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill. In all cases, LevelLife’s aggregate liability arising out of or related to the Service will not exceed the amounts actually paid by you to LevelLife for the Service in the twelve (12) months immediately preceding the event giving rise to liability. The foregoing cap does not limit liability for fraud, willful misconduct, or amounts that cannot be limited by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless LevelLife from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or for any other reason, with or without notice.

12. Changes to the Service and Terms

We may modify or discontinue parts of the Service at any time. We may also update these Terms. Material changes will be communicated by updating the date above and, where required, providing additional notice.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict of laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Service is the competent courts in Warsaw, Poland, and the parties consent to personal jurisdiction there. If you are a consumer domiciled in the European Economic Area or the United Kingdom, mandatory consumer protection rules of your country of residence may apply in addition to Polish law. The parties will first seek to resolve disputes amicably; if not resolved within 30 days, either party may bring the dispute before the competent courts.

15. License and Usage Limits

Subject to your compliance with these Terms, LevelLife grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal purposes. The app may be used for free up to level 5. Continued use beyond level 5 requires an active subscription purchased through the Apple App Store or Google Play. You will not: (a) copy, modify, or create derivative works of the Service; (b) reverse engineer or attempt to extract source code; (c) remove or obscure proprietary notices; (d) exceed any usage limits, seat counts, storage or rate limits communicated to you; or (e) access the Service to build a competing product.

16. Availability, Maintenance, and Support

We aim to keep the Service available but do not guarantee uninterrupted operation. Maintenance may occur with or without notice, including emergency maintenance. If we publish an uptime target or support plan, those terms govern; otherwise, support is provided on a commercially reasonable efforts basis and the Service is provided without any service-level commitments.

17. Customer Data; Security; Data Processing

As between you and LevelLife, you own all content and data you submit to the Service (“Customer Data”). You grant LevelLife a worldwide, limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service and as otherwise permitted by these Terms. We implement administrative, technical, and physical safeguards designed to protect Customer Data. Where we act as a processor on your behalf, our data processing terms (DPA) form part of these Terms and govern such processing, including use of subprocessors.

18. Data Portability and Deletion

During your subscription and for thirty (30) days after termination, you may export Customer Data using the Service’s available export features. After this period, we may delete or anonymize Customer Data from active systems, and backups will be purged in the ordinary course of business.

19. API, Rate Limits, and Fair Use

Use of any APIs is subject to published rate limits and fair use policies. We may throttle, suspend, or revoke API access that degrades Service performance or violates these Terms.

20. Confidentiality

Each party will protect the other party’s non-public information with the same degree of care it uses to protect its own similar information, and not less than reasonable care, and will use it only to perform under these Terms.

21. Copyright and DMCA

If you believe content on the Service infringes your rights, contact krispers.studios@gmail.com with details of the alleged infringement. We will respond to notices that comply with applicable law and may terminate repeat infringers.

22. Miscellaneous

Neither party will be liable for delays or failures due to causes beyond its reasonable control (force majeure). You may not assign these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger, acquisition, or sale of assets. If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect. These Terms are the entire agreement between you and LevelLife regarding the Service and supersede prior agreements regarding the Service.
